NOTICE IS HEREBY GIVEN that the Zoning Hearing Board of Tredyffrin Township will hold a public hearing at the Township Building, 1100 DuPortail Road, Berwyn, PA on Thursday, April 24, 2008 at 7:30 p.m. to hear the following Appeals:

APPEAL #15-08: Application of Peter vz. Hires, Sr., Hires Jr. to subdivide an approximately 62.2 acre parcel at their property located east of Yellow Springs Road and south of Horseshoe Trail, Malvern (Tax parcels 43-4-38, 43-4-44, 43-4-45, 43-4-45.1, and 43-4-49.1) in an R1/2 Residence District. Three variances from the Tredyffrin Township Zoning Ordinance are requested. First, a variance from Section 208-118.B(2)(a) is required to permit lots #1 and #2 to be re-graded with a disturbance exceeding 10% of the total steep slopes on the property. Second, a variance from Section 208-118B(2)(c) to permit construction upon a sloped area in excess of 25%. Third, a variance from Section 208-118.B(2)(d) is required to permit grading of an area in excess of 500 sf or 1% of the steeply sloped area on lots #1,2,3,4,6, and 8. And fourth, a variance is required to extend the expiration term of a variance as provided for in Section 208-148. In the alternative, an appeal from the determination of the Zoning Officer that variance relief from Sections 208-118.B(2)(a) and 208-118.B(2)(d) is required per Section 208-143.A.

APPEAL #22-08: Application of Gray Birchall to renovate the existing barn as a residence at 297 Adams Drive, Chesterbrook (Tax parcel 43-5F-43.1) in an R1 Residence District. Conversion of the barn into a dwelling unit would make the entire DuPortail House property into a multi family dwelling area which is allowed by special exception per Section 208-21.D(2) (Use regulations) of the Tredyffrin Township Zoning Ordinance. Such special exception is requested.

APPEAL #23-08: AApplication of Donna Potts et al to replace an existing fence at 915, 923, and 927 Copper Beech Lane, Radnor (Tax parcels 43-12A-12, 43-12A-11, 43-12A-10) in an R1 Residence District. Two variances from Section 208-109 (Front yard projections and exceptions) and Section 208-119.D (Fences, walls and security gates) of the Tredyffrin Township Zoning Ordinance are requested. No fence more than 4' in height shall be erected in the front yard is required. A 6' high fence along the property line facing Upper Gulph Road is requested.

APPEAL #24-08: Application of William & Joanne Doyle to continue to use the house as an eight unit apartment building at 282 Cassatt Road, Berwyn (Tax parcel 43-10F-153) in an R1 Residence District. A multi family dwelling is an allowed use by special exception per Section 208-21.D(2) (Use regulations) of the Tredyffrin Township Zoning Ordinance. Such special exception is requested.

APPEAL #25-08: Application of Megan and Arthur Belval to construct an 8' high deer fence around the property at 1471 Church Road, Malvern (Tax parcel 43-3-46.3) in an R1/2 Residence District. Two variances from Section 208-109 (Front yard projections and exceptions) and Section 208-119.D (Fences, walls and security gates) of the Tredyffrin Township Zoning Ordinance are requested. No fence more than 6' in height shall be erected in the side and rear yards, and no fence more than 4' in height shall be erected in the front yard is required. An 8' high fence around the entire property is requested.

APPEAL #26-08: Application of Catherine Bansbach to build a 5' X 8' greenhouse at 4 Walnut Lane, Berwyn (Tax parcel 43-10E-72.1) in an R1 Residence District. A variance from Section 208-22.D (Front yard) of the Tredyffrin Township Zoning Ordinance is requested. A front yard setback of 40' is required. A front yard setback of 33' is requested.

APPEAL #27-08: Application of 1475 Russell Road LP to adjust the lot line between two parcels and build an additional single family home at 1475 Russell Road, Wayne (Tax parcels 43-10J-20 and 43-10J-21) in an R1 and R2 Residence District. The applicant is requesting an interpretation of Section 208-22.A (Lot area and width) of the Tredyffrin Township Zoning Ordinance. In the alternative, a variance from Section 208-22.A (Lot area and width) is requested. A minimum lot area of 30,000 sf is required. A lot area of 25,906.87 sf is requested.

APPEAL #28-08: Application of David Cermak to construct a single family dwelling at 1607 Tyler Drive, Malvern (Tax parcel 43-4.48.1B) in an R1/2 Residence District. The applicant is requesting a variance from Section 208-18.C (Impervious coverage) of the Tredyffrin Township Zoning Ordinance. Fifteen percent (15%) of the lot area may be covered by impervious surface. Impervious coverage of approximately 29% is requested.

APPEAL #29-08: Application of David Bakker to construct a 5' high slip fence around the property at 2045 General Alexander Drive, Malvern (Tax parcel 43-5-2.13) in an R1/2 Residence District. Two variances from Section 208-109 (Front yard projections and exceptions) and Section 208-119.D (Fences, walls and security gates) of the Tredyffrin Township Zoning Ordinance are requested. No fence more than 4' in height shall be erected in the front yard is required. A 5' high fence around the entire property is requested.

An opportunity will be given any citizen and all parties in interest to be heard at the public hearing.
